These Terms of Service ("Terms") govern your use of the TextOrderAI SMS ordering service and website, operated by Run Horse Run LLC ("we," "us," or "our"). By using our service, you agree to these Terms.

1. Service Description

TextOrderAI provides an AI-powered SMS ordering system that allows customers to place food orders with participating restaurants via text message. We facilitate the ordering process between you and the restaurant.

2. Eligibility

You must be at least 13 years old to use our service. By using TextOrderAI, you represent that you meet this age requirement.

3. How the Service Works

  • You initiate a conversation by texting the restaurant's TextOrderAI phone number.
  • Our AI assistant helps you build your order from the restaurant's menu.
  • You confirm your order, provide your name, and select a pickup time.
  • You receive a secure payment link to complete your purchase.
  • The restaurant prepares your order for pickup at the selected time.

4. Messaging Consent

By texting our service, you consent to receive SMS messages related to your order, including order confirmations, status updates, and payment links. Message and data rates may apply depending on your carrier plan.

You can opt out at any time by replying STOP. Reply HELP for assistance.

5. Orders and Payment

  • All orders are subject to acceptance by the restaurant. A restaurant may decline or cancel an order for any reason.
  • Prices are set by the restaurant and may change without notice.
  • Payment is processed securely through our payment provider (Stripe). We do not store your credit card information.
  • Refund and cancellation policies are determined by each restaurant.

6. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose.
  • Send abusive, threatening, or harassing messages through the service.
  • Attempt to interfere with or disrupt the service or its infrastructure.
  • Impersonate another person or misrepresent your identity.

7. Disclaimer of Warranties

TextOrderAI is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted or error-free. We are not responsible for the quality, safety, or accuracy of food prepared by restaurants.

8. Limitation of Liability

To the fullest extent permitted by law, Run Horse Run LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the specific order in question.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes are posted constitutes your acceptance of the updated Terms.
